Larson attorneys represented a licensed physician assistant in a bench trial addressing ten disciplinary violations brought by the Physician Assistant Board, including engaging in the unlawful practice of medicine, prescribing medications without indication, committing gross negligence, and violating laws regarding the formation of medical corporations.
After a six-day trial the court dismissed nearly all the allegations, finding that a three-year investigation was only able to prove a minor, technical violation. There were no disciplinary actions imposed or costs awarded to the Physician Assistant Board.
The accusations centered on the physician assistant’s operation and ownership of a medical group providing cosmetic skin care services such as laser facials and injections, the role of the doctor acting as medical director, and alleged departures from standards of care for the procedures performed. After expert testimony from both sides, the court concluded that the medical group had been formed correctly and that the medical director was appropriately supervising the practice. Expert testimony also supported the standard of care given to patients, including the safety precautions taken and medicines prescribed.
