On May 8, 2023, Larson prevailed at trial, winning a rare motion for nonsuit in favor of clients, Cornerstone Financial, Daniel Pocius, Industrial Integrity Solutions, LLC, Frontier Homes LLC, Frontier Enterprises, and Frontier Communities, in the case of AgCon v. Cornerstone Financial et al in the Superior Court of San Bernardino County.
The trial between plaintiff AgCon, Inc. and defendants, Cornerstone Financial, Daniel Pocius, Industrial Integrity Solutions, LLC, Frontier Homes LLC, Frontier Enterprises, and Frontier Communities, involved claims that defendants Cornerstone Financial and Daniel Pocius breached a statutory duty of disclosure by allegedly concealing knowledge regarding a potential zoning change from the plaintiff prior to a land sale.
After four days of trial testimony, the Larson team successfully moved for nonsuit on the basis that future action by public officials cannot form the basis of a nondisclosure claim.
