Notable Wins
Full Victory for Walt Disney Parks and Resorts
On September 3, 2024, Larson achieved a full trial victory for its client Walt Disney Parks and Resorts in a suit brought by an Arizona couple seeking to regain membership to Disneyland’s exclusive Club 33, after it was revoked following allegations they failed to follow club rules.
Larson Obtains Unanimous Jury Trial Verdict for Alfa Consult SA
On January 17, 2024, the Larson team achieved a sweeping trial victory in federal civil case Alfa Consult SA v. TCI International, Inc. The dispute between Alfa Consult, a Luxembourg-based telecommunications company, and TCI International, based in California, centered on a contract for the construction of a system to manage Iraq’s national radio spectrum. The evidence presented at trial included allegations that TCI International breached its exclusive agency agreement with Alfa Consult in order to partner with a separate group based in Jordan.
Over the course of five days, the Larson team presented arguments and evidence supporting Alfa Consult’s claims for breach of contract and failure to act in good faith. The jury returned a unanimous verdict in favor of Alfa Consult on both counts and awarded it $5 million in damages.
Accusations Against Physician Assistant Dismissed
Larson attorneys represented a licensed physician assistant in a bench trial addressing ten disciplinary violations brought by the Physician Assistant Board, including engaging in the unlawful practice of medicine, prescribing medications without indication, committing gross negligence, and violating laws regarding the formation of medical corporations.
After a six-day trial, the court found that a three-year investigation was only able to prove one out of the ten violations. Because it was a minor, technical violation that the physician assistant has since corrected, no discipline was warranted, no costs were awarded, and the accusation was dismissed.
Complete Trial Victory for Autogroup
On April 25, 2024, Mach-1 Autogroup was awarded a complete trial victory in the latest in a series of legal disputes with plaintiff Marc Spizzirri. The case began with a lawsuit between Mr. Spizzirri and Mach-1 after a 2008 agreement to purchase Mr. Spizzirri’s Honda dealership in Santa Margarita fell through. Mach-1 asserted that Mr. Spizzirri was required to return deposits from the attempted sale and had also failed to repay a $1 million loan made as part of the transaction.
In the April trial, the court granted Mach-1’s motion for non-suit, finding that Mr. Spizzirri was not entitled to any amount of restitution and that Mach-1 did not mismanage entities that it seized after prevailing at an earlier trial.
